Terms of Use
Effective date: July 13, 2026
1. Acceptance of These Terms
These Terms of Use ("Terms") are a binding agreement between you and Fablins ("Fablins," "we," "us," or "our") governing your access to and use of fablins.com, our field guide, research archive, waitlists, membership programs, and any purchase of our products (collectively, the "Services"). By accessing or using the Services, you agree to these Terms and to our Privacy Policy. If you do not agree, do not use the Services.
We may modify these Terms at any time by posting a revised version with an updated effective date. Your continued use of the Services after changes take effect constitutes acceptance. Material changes to purchase terms apply only to orders placed after the change.
2. Eligibility
You must be at least the age of majority in your jurisdiction to make purchases. If you are under that age, you may use the Services only with the involvement and consent of a parent or legal guardian, and purchases must be completed by that adult. By using the Services you represent that you meet these requirements.
3. Our Intellectual Property
The Services and everything in them are owned by Fablins or our licensors and are protected by copyright, trademark, trade dress, and other intellectual-property laws worldwide. This includes, without limitation:
- All artwork and imagery — every creature illustration, product render, photograph, character design, packaging design, and graphic on the site.
- Characters and designs — the distinctive appearance and expression of every Fablin figure and character.
- Text and editorial content — all product descriptions, taglines, lore narratives, folklore write-ups, field notes, and archive entries, which are original expression authored for Fablins.
- Compilations and databases — the selection, arrangement, curation, and presentation of our field guide and world research archive.
- Trademarks — "Fablins"™, our logos, product line names, and trade dress. Nothing in these Terms grants you any right to use them.
Folklore itself belongs to the cultures that created it; our original retellings, characters, artwork, and compilations are ours.
4. Prohibited Uses of Content
Except for the limited license in Section 5, you may not, and may not help or permit anyone else to:
- Copy, download, reproduce, republish, upload, post, transmit, distribute, or publicly display any images, artwork, or product renders from the Services, in whole or in part, on any other website, social account, marketplace, print product, or medium.
- Use our images or content to create, market, manufacture, or sell any product, including prints, merchandise, NFTs, or competing figures.
- Create derivative works from our artwork, characters, lore, or designs.
- Scrape, crawl, harvest, spider, or systematically extract any content or data from the Services, whether manually or with bots, scripts, headless browsers, or other automated means, except by public search engines building general search indices.
- Copy, extract, or reuse our field guide or research archive data, in bulk or in substantial part, in any dataset, product, app, or publication.
- Use any content from the Services to train, fine-tune, ground, or evaluate any artificial-intelligence or machine-learning model or system without our express written permission.
- Frame, mirror, hotlink, or inline-link any part of the Services or embed our images on another site.
- Remove, alter, or obscure any copyright, trademark, watermark, or other proprietary notice.
- Reverse engineer, decompile, or attempt to extract the source code or underlying data of the Services, except where such restriction is prohibited by law.
We actively monitor for unauthorized use and will enforce our rights, including through takedown notices, platform complaints, and legal action seeking damages and injunctive relief. Unauthorized commercial use of our images or data causes irreparable harm for which monetary damages may be inadequate.
5. Your Limited License
We grant you a limited, personal, non-exclusive, non-transferable, revocable license to access and view the Services in your browser for personal, non-commercial purposes — browsing, learning about our products, and shopping. Sharing links to our pages, and platform-native sharing of our own social posts, is welcome. Any other use requires our prior written permission, which you may request via our contact form (choose "Partnership Inquiry" or "Press & Media").
6. Acceptable Conduct
When using the Services you agree not to:
- Violate any applicable law or regulation, or infringe the rights of others.
- Interfere with or disrupt the Services, servers, or networks, including via denial-of-service attacks, flooding, or spamming.
- Circumvent, disable, or probe any security, rate-limiting, or bot-protection feature, including our forms’ anti-abuse measures.
- Submit false, misleading, or fraudulent information, including fake orders, waitlist entries, or contact submissions.
- Use the Services to transmit malware or any harmful code.
- Impersonate Fablins, our staff, or any other person or entity.
- Purchase products for automated resale using bots or purchasing software.
7. Products, Pricing & Orders
- All prices are in U.S. dollars unless stated otherwise and exclude shipping and applicable taxes and duties, which are shown or estimated at checkout.
- We strive for accuracy, but product descriptions, images, colors, availability, and pricing may contain errors. We reserve the right to correct errors, update information, and cancel orders arising from errors — including after an order is placed — with a full refund of any amount charged.
- Product images are illustrative; actual figures may vary slightly in color and finish.
- Your order is an offer to purchase; a contract forms only when we ship. We may refuse or cancel any order at our discretion, including for suspected fraud, resale abuse, or quantity limits.
- We may limit quantities per person, household, or order, and may discontinue any product at any time.
Pre-orders and backorders: estimated ship dates are estimates, not guarantees; production timelines for collectible figures can shift. We will keep you informed of material delays, and you may cancel an unshipped pre-order for a full refund at any time. Waitlists: joining a waitlist reserves nothing and forms no contract — it only signals interest and subscribes you to availability notices.
8. Shipping, International Orders & Risk of Loss
We ship worldwide to most destinations. Shipping timelines shown at checkout are estimates. For international orders, you are the importer of record: customs duties, import taxes, VAT (where not collected at checkout), and brokerage fees are your responsibility and are not included in our prices unless expressly stated. Refused or undeliverable shipments may be refunded minus shipping and return costs. Title and risk of loss pass to you upon our delivery of the package to the carrier, except where consumer law in your jurisdiction provides otherwise.
9. Returns, Refunds & Statutory Rights
Our current return and refund practices are described at checkout or in our help communications; to start a return or report a damaged or defective item, use our contact form (choose "Order Support") within 30 days of delivery, and we will make it right — replacement or refund for items that arrive damaged or defective. Nothing in these Terms limits any non-waivable statutory rights you have in your country of residence, including EU/UK consumers' 14-day right of withdrawal for online purchases and statutory conformity guarantees.
10. Memberships & Promotions
Membership programs (such as The Society), discounts, and promotions are subject to their stated terms, are personal to you, may not be resold or transferred, and may be modified or discontinued prospectively. Discount abuse (including stacking exploits or automated redemption) may result in order cancellation or membership termination with a pro-rata refund where required by law.
11. Feedback & Submissions
If you send us ideas, suggestions, creature reports, or other feedback, you grant us a perpetual, irrevocable, worldwide, royalty-free license to use them without restriction or compensation, and you represent you have the right to do so. Do not send us anything confidential.
12. Third-Party Services
The Services rely on third parties — including Shopify for checkout and payments — and may link to external sites. We are not responsible for third-party content, terms, or privacy practices. Your use of those services is governed by their own agreements.
13. Copyright Complaints (DMCA)
We respect the intellectual property of others. If you believe content on the Services infringes your copyright, send a notice via our contact form including: your contact information; identification of the copyrighted work and of the material claimed to infringe (with URL); a statement of good-faith belief that the use is unauthorized; a statement, under penalty of perjury, that the notice is accurate and you are authorized to act; and your physical or electronic signature. We will respond as required by the U.S. Digital Millennium Copyright Act and equivalent laws.
14. Disclaimers
THE SERVICES AND ALL CONTENT ARE PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT, EXCEPT WHERE SUCH DISCLAIMERS ARE NOT PERMITTED BY LAW. WE DO NOT WARRANT THAT THE SERVICES WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE.
Our field guide and research archive are entertainment: folklore, legend, and creative retellings. They are not statements of fact about real creatures, places, or persons, and no sighting, threat level, or field note should be relied on for any purpose other than enjoyment.
15. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, FABLINS AND ITS OFFICERS, EMPLOYEES, AND AGENTS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR LOST PROFITS, REVENUE, DATA, OR GOODWILL, ARISING FROM OR RELATED TO YOUR USE OF THE SERVICES OR PRODUCTS, EVEN IF ADVISED OF THE POSSIBILITY. TO THE MAXIMUM EXTENT PERMITTED BY LAW, OUR TOTAL AGGREGATE LIABILITY FOR ALL CLAIMS WILL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID US FOR THE PRODUCT OR SERVICE GIVING RISE TO THE CLAIM IN THE TWELVE MONTHS BEFORE THE CLAIM AROSE, OR (B) FIFTY U.S. DOLLARS (US$50).
Some jurisdictions do not allow certain exclusions or limitations, so parts of the above may not apply to you; in that case our liability is limited to the fullest extent permitted by applicable law. Nothing in these Terms excludes liability that cannot be excluded by law, including for fraud or for death or personal injury caused by negligence.
16. Indemnification
You agree to defend, indemnify, and hold harmless Fablins from and against claims, damages, liabilities, costs, and expenses (including reasonable attorneys' fees) arising from your violation of these Terms — including any unauthorized use of our content or data — or your violation of any law or third-party right.
17. Termination
We may suspend or terminate your access to the Services at any time, with or without notice, for conduct that violates these Terms or is otherwise harmful to the Services, other users, or us. Sections 3–5, 11, and 13–19 survive termination.
18. Governing Law & Disputes
These Terms and any dispute arising from them or the Services are governed by the laws of the State of South Carolina, USA, without regard to conflict-of-law rules, and you agree to the exclusive jurisdiction and venue of the state and federal courts located in South Carolina — except that if you are a consumer in the EU, UK, or another jurisdiction whose law grants you the right to sue or be sued at home, you retain that right, along with any entitlement to use national consumer dispute resolution bodies or the EU Online Dispute Resolution platform. Before filing any claim, you agree to contact us via our contact form and give us 30 days to resolve the issue informally.
19. General
These Terms, together with the Privacy Policy and any product-specific terms presented at purchase, are the entire agreement between you and us regarding the Services. If any provision is held unenforceable, the remainder stays in effect, and the provision will be enforced to the maximum extent permissible. Our failure to enforce any right is not a waiver. You may not assign these Terms; we may assign them in connection with a merger, acquisition, or sale of assets. Notices to you may be provided via the Services or email; notices to us must be sent via our contact form.
